In October, a US jury awarded a truck driver $15.5m in damages after he suffered what Freightwaves describes as “catastrophic injuries”. Isaac Espinoza was injured while changing a tyre. Although the decision to award damages is nothing new, the report suggests the case proved a landmark in apportioning liability, with broker JB Hunt shouldering 40% of the blame. This, it says, could spell big problems in the future for 3PLs which fail to mitigate.
